A settlement has been proposed (the “Settlement” or “Settlement Agreement”) with Defendant Al Piemonte Nissan (“APN”) in a class action lawsuit involving allegations of violation to the Telephone Consumer Protection Act (“TCPA”). The Settlement resolves a lawsuit involving allegations that settlement class members received text messages sent by, or calls from, or on behalf of APN within a 12-month period while their residential telephone numbers were listed on the National Do Not Call Registry for at least thirty (30) days.
The class action lawsuit is called Hazem Arman v. Al Piemonte Nissan, Case No. 2026LA000850. APN is an automotive dealership and denies all allegations and wrongdoing in the lawsuit, including on the grounds that it had an established business relationship or prior express written consent of persons it contacted by text or call. The Court has not decided who is correct.
The parties have agreed to a settlement of the legal claims in the complaint to avoid the cost of a trial, the risk and uncertainty of proceeding forward in the lawsuit, and to provide compensation for Settlement Class Members.
If you have received notice from the Settlement Administrator via email or postcard, then APN’s records indicate that you may be a Settlement Class Member and entitled to benefits under the Settlement.
Your rights are affected whether you act or don’t act. Please read the Notice and this website carefully and completely.
