If you are an individual residing in the United States who received contact from or on behalf of Al Piemonte Nissan (“APN”), within a 12-month period of May 9, 2021, through September 16, 2026, while your residential telephone number was listed on the National Do Not Call Registry (“DNC”) for at least thirty days, you may be entitled to a payment from a Class Action Settlement. Excluded from the Settlement Class are: All class members who timely and validly exclude themselves from the Settlement.
If you are a Settlement Class Member and wish to receive Settlement payment then you must submit a Claim Form by December 15, 2026.
Al Piemonte Nissan has agreed to create a Settlement Fund, consisting of up to $3,700,000.00 in non-expirable vouchers (which may be redeemed for any products or services from APN) or up to $740,000.00 in cash. The Settlement Fund will be used to pay notice and administration costs, attorneys’ fees and costs awarded to Class Counsel, and any service award approved for the class representative. The net remaining funds will be used to pay Settlement Class Members who submit valid claim forms for the benefits described below.
Settlement Class Members who submit a timely claim will receive a $100.00 voucher or $20.00 cash payment (member’s choice) per person. Settlement Class Members need only to submit one Claim Form to receive payment for all text messages and calls that Settlement Class Member received. If the amount of the Settlement Fund is insufficient to pay a $100.00 voucher or $20.00 cash payment to each Settlement Class Member who files a valid Claim Form, payments will be reduced and paid on a pro rata (a legal term, meaning “equal share”) basis, so that the total of all payments, together with any Court-approved attorneys’ fees and expenses, notice and administration costs, and any service award, does not exceed the Settlement Fund.

The deadline to submit a Claim Form online is December 15, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than December 15, 2026.
